Terms of Use

1. About these terms

These Terms of Use govern access to and use of ECE Assist, operated by [LEGAL BUSINESS NAME], ABN [ABN], referred to as “ECE Assist”, “we”, “us” or “our”.

By creating an account, continuing with Google, purchasing a subscription or using ECE Assist, you agree to these terms and acknowledge the Privacy Policy.

2. Purpose of ECE Assist

ECE Assist is a documentation support tool for early childhood education students, educators and authorised professionals. It helps transform factual observations into draft professional documentation.

ECE Assist is not a replacement for educator judgement, supervision, service policies, regulatory requirements or professional review.

3. Account responsibilities

You must provide accurate account information, keep your login details secure and notify us promptly if you believe your account has been accessed without permission.

You are responsible for all activity performed through your account unless the activity resulted from a security failure for which ECE Assist is legally responsible.

4. Your content

You retain responsibility for factual observations, uploaded files and other material entered into the service. You confirm that you have lawful authority and any required workplace or parental consent to enter or upload that information.

You must review all extracted and generated content before using it in professional records, assessments, communications or regulatory documentation.

5. Prohibited use

You must not use ECE Assist to submit unlawful, harmful, abusive, discriminatory, misleading or infringing content; attempt to compromise the service; bypass subscription restrictions; access another user’s account; or use generated content without appropriate professional review.

6. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted, error-free or permanently available access. Maintenance, provider outages, security incidents and technical changes may temporarily affect availability.

7. Intellectual property

ECE Assist, its software, branding, page designs, prompts, workflows and system components remain owned by or licensed to [LEGAL BUSINESS NAME].

Subject to these terms, users may use generated documentation for their legitimate educational and professional purposes.

8. Liability and consumer rights

To the maximum extent permitted by law, ECE Assist is not responsible for loss caused by relying on unreviewed AI output, entering inaccurate facts, failing to obtain consent, or using the service contrary to professional or legal obligations.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

9. Suspension and termination

We may restrict or suspend access where reasonably necessary to address unlawful activity, security risk, payment failure, serious misuse or breach of these terms.

10. Governing law

These terms are governed by the laws of Victoria, Australia. The parties submit to the courts having jurisdiction in Victoria, subject to any rights that cannot lawfully be restricted.

AI and Professional Responsibility Disclaimer

ECE Assist uses artificial intelligence to assist with drafting learning analyses, framework links, reflections, planning suggestions, transcription and other documentation.

AI-generated content may contain errors, omissions, unsuitable wording or incorrect framework links. Outputs are drafts and must not be treated as automatically accurate or complete.

The educator or authorised professional remains responsible for:

  • verifying that factual information is accurate;
  • reviewing, editing and approving every output;
  • applying professional judgement;
  • complying with the EYLF, VEYLDF, NQF, service policies and applicable law; and
  • ensuring documentation appropriately reflects the individual child.

ECE Assist does not provide medical, psychological, legal, diagnostic, child-protection or developmental assessment advice.

Do not make significant decisions affecting a child solely from AI-generated content.

Document 3

Child Data and Acceptable Use Policy

Users must only enter child-related information where they have lawful authority and have followed their service’s consent, privacy and record-handling requirements.

Use initials or a shortened identifier where possible. Only enter information reasonably necessary to create the documentation.

Unless clearly authorised and necessary, do not upload or enter:

  • full names together with identifying details;
  • home addresses or private contact details;
  • unnecessary medical or family information;
  • government identifiers;
  • court, child-protection or custody records;
  • photographs clearly identifying children; or
  • information about another family without authority.

Users must not use ECE Assist to diagnose a child, produce false records, misrepresent an observation, discriminate against a child or replace mandatory reporting and child-safety procedures.

Users remain responsible for checking scanned handwriting, dictated text, recorded times and factual observations before generation.

Document 4

Subscription, Cancellation and Refund Policy

ECE Assist may offer Free and paid Pro plans. Current inclusions and prices are displayed on the Pricing page before purchase.

Paid subscriptions renew automatically at the displayed billing interval until cancelled. Payments are securely processed through Stripe. ECE Assist does not directly store complete payment card information.

Users may manage or cancel an active subscription through Account & Billing. Unless otherwise stated during cancellation, Pro access continues until the end of the current paid billing period.

Access may be limited where a recurring payment fails or remains unpaid.

Refund requests may be submitted to [SUPPORT EMAIL]. ECE Assist will review each request based on the circumstances, these terms and applicable Australian law.

Approved refunds are processed securely through Stripe and are returned to the original payment method. Processing times may depend on the customer’s bank or payment provider.

Nothing in this policy limits any refund, resupply or other remedy available under the Australian Consumer Law.

Nothing in this policy limits a right to a refund, replacement, resupply or other remedy where that right exists under applicable law.

Document 5

Data Retention and Account Deletion

Account and subscription information is retained while an account remains active and for a reasonable period afterwards where required for security, billing, dispute resolution, fraud prevention or legal compliance.

Before launch, confirm: whether uploaded images, microphone audio, transcripts and generated documents are temporarily processed only or stored after processing.

Current planned retention statement:

Browser drafts and theme preferences may be stored locally in the user’s browser. Users can remove that information by clearing their browser storage.
